Terms of service

Versão PT-BR aqui

All the information here is aimed towards personal commissions only.

If you want our work for commercial/business purposes email us at: daburu.art@gmail.com so we can further discuss the matter.

♦ What we won’t draw ♦

- Disturbing imagery (some extremely violent concepts, apologism to questionable ideologies, discrimination, etc);

- Gore;
- Explicit porn (we are ok with some ecchi/NSFW-ish, feel free to ask if we would work with your idea. No judgments!);
- Intricate background (it can be open to discussion, but generally we prefer not to).

Please note that we reserve the right to turn down any commission we don't feel comfortable doing, regardless of what it is.

♦ Payment ♦

- Should be made full upfront, through paypal in USD only.

We may agree to partial payment for some more expensive commissions
(Our refund policies can be found further bellow)

Please be aware that:
- Prices may vary depending on what you ask.

- Anything besides what is already offered in our examples can be considered an extra, and they will result in additional fees (extra characters, background, companion animals, complex clothing, complex prop, wings, etc.)

- Unless it's something really complex, we’ll finish a commission within 2 weeks.

- Communication is important, so we ask you to be as clear as possible when telling us what you want us to do. We won't mind doing alterations, but after something gets approved and we go forward with it, there will be no backtracks. There can be extra charges if that happens, or if we have to deal with constant alterations.

♦ Process ♦

  1. After we negotiate a price, we’ll send you the invoice and wait for the payment before starting.

  2. We will start working on the piece step by step and it may vary depending on the current request. On each stage, we’ll send you an update and ask for feedback. After it gets approved, we won't be coming back to change big things in later stages.

  3. If we agreed to it and you’ve paid me a partial value, we'll wait until the rest of the payment comes through before sending you the final file.

♦ REFUND POLICIES & TERMS OF SERVICE ♦

On paying our invoices, you're both confirming and agreeing to the following terms, conditions and information:

(1) Your commission is for PERSONAL USE EXCLUSIVELY.

You won’t use it for profitable purposes, like making prints, clothes, mugs, posters, etc.
Commissions for commercial use are a completely different type of work and the client NEEDS to inform us beforehand so we can properly negotiate.

(2) We, the studio, reserve the right to use any finished commission we make as we see fit.

We reserve the right to use any commission we made in order to promote ourselves and post it on social media, sell, etc, unless we both have explicitly agreed that we can’t do that.

(3) 50% of the TOTAL agreed value is non refundable.

This portion of the payment is used to buy a spot on our work queue, so it won’t ever be refunded. Please be aware that the “50% of the value” refers to the total price we agreed for the piece, so it’s irrelevant the price paid in specific invoices, what matters is the complete value we agreed over email.

(4) Your money WON’T be refunded at all if we already started working on your piece and have advanced a few steps on it.

If you for whatever may be the reason decide to cancel the request but we are already past the refined sketch step of creating your piece, none of your money will be refunded as you're paying for our invested time and services, and not necessarily for the product itself. So in those cases, regardless of you not wanting my product anymore, since we’ve already spent too much time on your request, nothing of what you paid us will be eligible to be refunded.

(5) You’re only eligible for a full refund if we, the studio, decide to not work on your piece anymore for reasons not directly related to said piece; or; after paying us you send me an email asking for updates and we don't answer within a month.

Examples: if we get ill, if we have to travel, if we simply can't complete the task anymore, etc, as long as the reason isn't directly related to the work in question a refund is eligible.

So just to reinforce, we will NOT give a full refund in cases that we refuse to work further on a commission due to disagreements with the client and likewise problems. Examples: the client being extremely impolite; the client not liking for some reason some part of our work and being extremely rude; the client making constant changes in what we originally agreed and not accepting when we refuse to abide; being too unprofessional and unreasonable to work with; coming up constantly with unreasonable demands; demanding something not originally agreed; demanding the job to be delivered faster than it was agreed to;
Those are but a few examples, but in summary: excessive unprofessional behaviors and unreasonable demands regarding what we’ve agreed on.

Those are some extreme cases in which the clients make it virtually impossible to work alongside them, and we reserve the right to refuse continuing to work in such conditions without owing the client a full refund for turning down the work. In this situation, term (3) and (4) applies, so at the very least 50% won’t be refunded while the rest should be analyzed if it's eligible to be refunded. Usually this kind of situation should be sorted out via email like the rest of our negotiation, but in cases where this is not possible and third parties are involved (like paypal staff for instance), remember that on paying our invoices you're agreeing to all those terms and conditions we are listing here.

(6) Everything discussed through email (or whatever means of communication used) should be considered as valid as those terms written here.

(7) This is a DIGITAL SERVICE, which means there WON'T be a PHYSICAL item to be shipped and/or delivered.
On paying our invoices, you’re confirming that you’re aware of this.

(8) You have read our “Terms of service” section in our site.
There is important information regarding payments, our work methods and process, etc, so you should read them before ordering us an art piece. On paying this invoice you’re confirming that you’re aware of this and that you have read it.
